Successful Fight Against Crimes of Infringement on Intellectual Property Rights
In recent years, especially since our country entry to WTO, we have made great progress in many aspects, such as handling cases of disputes on intellectual property rights, protecting the legitimate rights and interests of the owner in accordance with the law, and punishing crime of infringing the intellectual property rights.
The statistics show that from 2000 to November of 2004, the people's courts at all levels of the whole country tried 1710 criminal cases of infringing intellectual property rights and sentenced 1948 people. The number of case was on the increase in the last three years, up by 56.42%.
From January of 2002 to October of 2004, the people's courts at all levels of the whole country tried 2171 cases of producing and selling the inferior quality goods, and 3830 cases of illegally running, quite a few among them were the case of infringing the intellectual property right.
The procuratorate organs launched special supervision to attack crime of manufacturing and selling the fake, and infringing intellectual property right and having remarkable achievement.
The statistics show that from 2000 to November of 2004, the procuratorate at all levels of the whole country approved 2462 arrests involved in1539 cases of infringing intellectual property rights, and instituted legal proceedings against 2491 persons involving in1500 cases. In the last three years, the number of approved arrested and legal proceedings cases was on the increase obviously, up by 35.6% and 75.1% respectively compared with past three years.
From January of 2002 to October of 2004, the procuratorate at all levels of the whole country approved 5580 arrests involved in 2769 cases of producing and selling the inferior quality goods, and instituted legal proceedings against 5474 persons involved in 2260 cases; approved arrest 5884 in 3492 cases of illegal selling, and instituted prosecution 5675 persons involving in 3282 cases.
In order to attack crime activity of infringing the intellectual property right in accordance with the law, the Supreme People's Procuratorate launched special supervision to attack crime of manufacturing and selling the inferior quality goods, and infringing intellectual property right since March this year. Over 8 months, the procuratorial organs at all levels of the whole country, ccording to the unified plan of the Supreme People's Procuratorate, promoted their work solidly, achieving the phased achievement.
